GENERAL CONDITIONS OF SALE

General Provisions

These general conditions of sale (hereinafter, “General Conditions”) apply to all sales of products (hereinafter, “Products” or “Product”) purchased through the website www.shyna.eu (hereinafter, “Site”).
The use of the distance selling service described in these General Terms and Conditions is reserved exclusively for consumers (hereinafter referred to as “Customers” or the “Customer”), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activity, if any.
The language available to conclude the contract is Italian.
The Customer is required to read carefully the General Terms and Conditions that have been made available to him/her on the Site, in order to allow their storage and reproduction by the Customer pursuant to Art. 12 of Legislative Decree April 9, 2003, no. 70.
The contracts concluded with Shyna Di Moustapha Sane with Registered Office: via ugo foscolo 21, – 93100 Caltanissetta (CL) – REA CL-119716 – P. Iva 02081910859 (as defined below) through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, no. 206 (“Consumer Code”) and by Legislative Decree April 9, 2003, no. 70 (hereinafter, “Ecommerce Decree”).

  2. Product-related information
    Information about the Products susceptible to distance selling through the Site is available, with the relevant product codes, on the Site. The above information is provided in accordance with Articles 52 and 53 of the Consumer Code.
  3. Price
    Product prices are inclusive of all taxes and fees. All prices are in Euros. Shipping costs are the responsibility of the customer, except for any promotions and discount codes.
  4. Order of Products
    The essential features and prices of the Products are given in the offer for each Product.
    To purchase the Products, the Customer must complete online and submit the order form, following the instructions on the Site. The Customer shall place the Product in the appropriate “shopping cart” and, after reviewing the General Conditions, shall select the desired payment method and choose the “Confirm Order” option.
    Before submitting their purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate editing procedure contained on the Site. In particular, the Customer has the right to change the quantity of the Products he/she intends to purchase by adding or removing one or more Products from the “shopping cart”.
    By submitting the order, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase process and fully accepts the General Conditions.
    The Customer will have the ability to view and track the status of their order through the “Orders” area of their account. Shyna Handmade reserves the right to evaluate the acceptance of orders received. Shyna Handmade shall notify the Customer of any inability to accept orders received within 30 days beginning on the day following the day on which the Customer submitted the order to Shyna Handmade and shall refund any sums already paid by the Customer for payment of the supply.
  5. Methods of payment
    The Customer may make payment of the price of the Products and related delivery charges by Credit Card, PayPal, (on PayPal’s secure and safe server) or by Bank Transfer.
    Payments made with all major Credit Cards are accepted, including: Visa, MasterCard and American Express. The transaction will be charged to the Customer’s credit card only after:
    (a) credit card information has been verified (on secure server directly from PayPal, we will not have any direct access to your information), b) a debit authorization has been received from the credit card issuer used by the Customer and the availability of the Product has been confirmed by Shyna Handmade.
    Shyna Handmade also accepts payments made by Bank Transfer. Any bank charges will be borne by the Client. In the event that, for whatever reason, charging the amounts due by the Customer proves impossible, the sale process is automatically cancelled and the sale automatically cancelled.
  6. Confirmation of receipt of order
    In accordance with the provisions of Art. 53 of the Consumer Code, the Customer receives, at the time of the execution of the contract, by e-mail, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, the essential characteristics of the product ordered, its price, the amount paid, the existence of the right of withdrawal – with an indication of the time and method for returning the goods – the geographical address to submit any complaints and information on the existing support services and commercial guarantees.
  7. Ineffectiveness of the order
    No contract shall be deemed to have been concluded between Shyna Handmade and the Customer if Shyna Handmade has reasonable grounds to believe that the Customer is not acting pursuant to a genuine and actual interest in the purchase of the products ordered, or is abusively exercising the right of withdrawal recognized in Article 10 below. In such cases, the order placed by the Customer shall be deemed to be of no effect whatsoever. Shyna Handmade will send to the Customer, by e-mail, a notice stating that the Contract has not been concluded, also taking care of the cancellation of any charges and/or expenses borne by the Customer.
  8. Transport and delivery
    Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request delivery of the products to an individual of his choice, whose residence or domicile is located within the territory of Italy. The signature of an adult over the age of 18 will be required at the time of delivery. No deliveries will be made to P.O. boxes.
    For each order placed on the Site, Shyna Handmade will issue an invoice for the goods shipped, sending it by e-mail or mail to the order holder, pursuant to Presidential Decree 445/2000 and Legislative Decree. 52/2004. The information provided by the Customer when placing the order shall be used as the basis for issuing the invoice. No changes in the invoice will be possible, after it has been issued.
    Delivery charges are the responsibility of the Customer and are separately highlighted on the Site and on the order form.
    All purchases will be delivered by express courier Monday through Friday, excluding holidays and national holidays. Shyna Handmade is not responsible for unforeseeable delays.
    Shyna Handmade will send the Customer a confirmation e-mail once the Products have been shipped, in which will be specified the tracking number of the shipment through which it will be possible to view, upon entry on the Courier’s website, the status of the shipment.
    In any event, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products shall be delivered within a maximum period of 30 (thirty) days from the day following the day on which the Customer has transmitted the order to Shyna Handmade, unless Shyna Handmade communicates – within the same period, by e-mail – the impossibility of delivering the ordered goods due to the unexpected unavailability, even temporary, of the Products. In case of such notice, Shyna Handmade will refund any sums already paid by the Customer for the payment of the supply. In the event that, upon Shyna Handmade’s notice of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the Customer shall be refunded as soon as possible, but no later than 30 (thirty) days from the day following the day on which the Customer submitted the Order to Shyna Handmade.
    Delivery of the goods requires the presence of the Customer or his/her designee at the recipient’s address indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages being delivered corresponds to what is indicated in the transport document and that the package is intact or not altered. Any damage to the package and/or the Products or mismatch in the number of packages must be immediately contested by means of written control reservation on the Courier’s proof of delivery. Once the Courier’s document has been signed, the Customer will not be able to make any objection about the external characteristics of the delivered package.
